Suspended DIS legal director refusing with Khama, Kgosi docket

Pulane Kgoadi - one of the suspended officers of the Directorate of Intelligence and Security (DIS) who is the director legal - is accused of refusing to hand over documents relating to investigations against former President Ian Khama and former DIS boss, Isaac Kgosi.This is according to a letter of suspension authored by DIS Director General Peter Magosi dated 24th April 2024. In the suspension letter seen by this publication, Magosi indicates that there is also a matter that remains outstanding arising from the instruction given to Kgoadi to retrieve and to hand over to another officer designated and assigned by Magosi in Kgoadi’s place and “stead, all files, exhibits, documents and all evidentiary material, all the information relating to on-going investigation concerning the former President Lieutenant-General Ian Khama Seretse Khama and Isaac Seabelo Kgosi.”Magosi recorded that this is a prior instruction which was given to Kgoadi by him several weeks ago and to date, it has not been complied with.“I must view your conduct as an act of gross insubordination deliberately calculated to undermine the authority of the office of the Director General.“Having regard to the gravity of this matter, you are hereby directed with immediate effect to carry out the instruction in question and to report in person to the Chief of Staff of the Directorate before 5.00 pm today and to deliver all the outstanding files and all other material and documents, pertaining to the on-going investigation referred to in paragraph 9 above,” Magosi said in the letter.He stated that there is also a matter that remains outstanding arising from Kgoadi’s refusal to hand over her mobile phone(s) for forensic examination to the team of DIS / Botswana Police, investigating employment-related matters and in addition, whether there are criminal offences or crimes which might have been committed by her alone and/or with others as suspects in the course and scope of her employment or otherwise.According to Magosi he is made to believe that all of Kgoadi’s other colleagues have duly complied with the instruction and/or request from law enforcement officers to hand over the mobile phones. He said it therefore appearsthat Kgoadi is the only one who refused to comply.He added that, “having regard to the gravity of this matter, you are hereby directed with immediate effect to hand over your mobile phone(s) to the Chief of Staff of the Directorate before 5.00 pm today and to your mobile phone(s), pertaining to the on-going investigations referred to in paragraphs 9 and 10 above.“Failure to comply may result in your immediate arrest and detention and will be the subject of disciplinary charges of gross misconduct against you which may lead to termination of your employment.”Kgoadi has been directed to surrender with immediate effect, her Certificate of Identity, service weapon, arms and ammunition, the motor vehicle, mobile phones, sim cards, laptop, iPad, computers, credit cards, keys, access cards, security passes, any other work- related gadget, documents, manuals, and all other material and records in “your possession in relation to your employment, or in respect of any position or office or other capacity, duties and responsibilities in which you have been serving as a signatory, representative or trustee or other position on position on behalf of the Directorate and/or the Government of Botswana as the employer, in accordance with the disciplinary procedures and the provisions of any applicable written laws, including the Intelligence and Security Service Act [Cap.23:03]”.Sources within the intelligence have claimed that Kgoadi and Setlhabi chanced upon damning information against powerful individuals including their boss. It is alleged that this troubled their boss who then came with a claim that the duo is working with former President Khama and that Kgoadi has received about P4.1 million.Kgoadi, Paul Setlhabi and Kuda Malikongwa who are serving suspension, have taken the Directorate and Magosi together with Botswana Police to court seeking an interim order that the DIS and Police be interdicted from arresting, detaining, searching their motor vehicles and putting them under surveillance.The case will be heard on the 27th of May 2024 before justice Boipuso Makhwe.
