Three men accused of raping 13-year-old girl denied bail
The Lobatse Magistrate's Court on Monday denied bail for the three men accused of raping a 13-year-old girl in Kgoro village while shooting a video. The accused, 30-year-old Oabile Mothomi, allegedly a Sangoma, 19-year-old Phenyo Khubitla, and 17-year-old Botshelo Motswagole, faced one count of rape linked to an incident on July 11, 2025. They had requested bail, promising to stay away from the victim, but Principal Magistrate Tshoganetso Atamelang refused their application.
The magistrate cited community outrage over the incident and stressed the need to consider the victim’s welfare before any bail decision is made.
The Magistrate said that social workers will be involved as part of the process while investigations continue. In previous court proceedings, Motswagole, who is supposed to be sitting for his Form Three examinations this year, pleaded for release to prepare for his upcoming examinations. However, the court insisted all three remain in custody.
The case drew national attention after the video circulated online showing the girl being raped while crying for help. Reports say Mothomi claimed he 'bought' the girl, suggesting he saw the act as a
transaction. Kgoro Village Chief James Tekanyo previously told The Midweek Sun that he was deeply disturbed by the incident, calling for prayers and stronger measures to protect children.
He warned parents against leaving their children unattended in the village, saying it exposes them to abuse.
The trio is expected back in court on October 20 as the investigation continues.
