DCEC top brass frustrates crucial investigations

The Minister of State President, Moeti Mohwasa, has been called upon to institute an investigation into the conduct of Justice Dr Zein Kebonang and some of the Directorate on Corruption and Economic Crime (DCEC) top brass.An Investigator at DCEC, Jako Hubona says the conduct by some DCEC top brass and Kebonang J was outrightly unprofessional and was an Abuse of Public Office contrary to section 24A (1) as read with section 23 (d) of the Corruption and Economic Crime Act, 1994, Laws of the Republic of Botswana.Hubona has appealed to the minister to consider instituting investigations into the conduct of these persons, since they frustrated the efforts of the investigating team that was appointed in writing to investigate and establish the truthfulness of the allegation of the suspected missing funds at the Bank of Botswana (BOB).Hubona has found himself thrown under the bus in the controversial ‘Butterfly’ case in which P100 billion was allegedly stolen and transferred into three foreign accounts by former President Ian Khama, former Director General at the Directorate of Intelligence and Security, the late Isaac Kgosi, and DIS agent, Weleheminah Maswabi.Hubona finds himself isolated after his affidavit was said to be a fabrication of events.In a letter written to the minister, Hubona stated that in his capacity as an investigator, he was investigating some cases that are now of public interest due to inadvertent leakages to the media and meddling and interference in the investigations by some people who have vested interests.“The most famous cases amongst them are the “Butterfly Case and Capital Management Botswana (CMB), Botswana Public Officers Pension Fund (BPOPF) case, which in part were completed at both magistrate and Court of Appeal.The remaining part is still to go to court as soon as the South African authorities hands over one of the main suspects Mr Timothy Gordon Marsland to Botswana authorities to face trial with another Botswana Citizen Male Mr Rapula Okaile”, Hubona said.The frustrated investigator stated that these cases have proven a thorn in his flesh that refuses to leave him and his family. He revealed that it has negatively affected his life and that of his wife and children to the point where they are almost being ostracised by society in general.“I wish to state further that a week or so before Kebonang J delivered the above stated judgment, he did visit the DCEC office and met with some DCEC top brass some of whom were part of a teamdealing with Ass No: 750/2019.The meeting, as per information I received from highly placed reliable sources, was mainly to discuss the investigation I was leading concerning the 'Butterfly' case under Ass No. 508/2019 and the affidavit I deposed requesting Kebonang J to recuse himself from the CMB/BPOPF review application.When confronted, DG DCEC at the time, Mr Tymon Katlholo stated that a meeting between them and Kebonang J, was about Kebonang J, who had come to report Ms Israel for leaking an affidavit I had deposed requesting that he recuse himself from the CMB/BPOPF review application”, Hubona explained.He confirmed that indeed Butterfly made a review application for her case to be heard at the High Court, and the matter was allocated to Justice Dr Kebonang and he was not cited as one of the parties in the application."The judge in delivering the judgment, personally attacked me following his meeting with DCEC top brass because of the affidavit I deposed requesting him to recuse himself from the CMB/BPOPF review application."DCEC has not responded to the damning allegations. Minister Mohwasa had also not responded to our enquiries at the time of writing.
